The trilli tri award is being offered by the Seaforth Horticul- tural society as an incentive to beautiful homes and their sur- roundings by planting trees and flowers. Nomination cards may be ob- tained and returned to the secretary Mrs, L. Stephenson by both member and non member. Judging will be during the first week in August and again the first week, in September. The award will be given if sufficient points art obtained in the following areas; originality of garden and landscape design; cleanlines of building, 'flower beds and borders; maintenance of trees, hedges, flower beds in relation to pests, general appear- ance of lawn; use of colour in flowers and shrubs in relation to building; contribution of the property to beautification of the neighbourhood. Mrs.ElwinWilson of Flarpurhey charged her neighbor , Lorne Whittaker, 29, owner of a body shop, with assuit. Mrs. Wilson told the court that she was digging a trend) to let the water get ' out, when Mr. Whittaker st epped on her shovel, and told her to rnind her own business, it wasn't her property. Earlier in the morning, he had words with both Mr. and Mrs. Wilson about digging on township property. Mr. Whittaker said h e was warned earlier by Tucke rsmith township not to disturb its property and his neighbors; were digging across his driveway. So in the afternoon, she w.as out shovelling again and he stood in front of her to stop her from shovellilng, he said. Mrs. Wilson said: "1 was ignoring him," but he 'would jump in front of her and step on her shovel. She said she stepped back, he doubled his fist and came running toward her and hit hear in the chest. Mrs. Wilson said she fell in the water, and he 'kicked her while she was on the ground. She said she went to the doctor with complains about soreness -in her chest, but no bones were broken and her doctor refused to testify. Mr. Whittaker said: "No way am I going to lay a finger on 'a lady in that way." "I sure wouldn't have my job very long if anything like this was going to happen." Mr.Whittaker said he is now working in Simcoe and does not plan to be back in this area for some time. Crown Attorney W. G. Cochrane said there was no evidence showing bodily harm. Judge Hays said he found both witnesses credible and since there remained a shadow of a doubt as to what had happened, he found Mr. Whittaker not guilty. A counter-charge was then dropped against Mrs. Wilson regarding the same incident. John A. Miller, 20, of 38 Anne St. pleaded guilty to causing a disturbance by fighting at Aithie's Sunoco on May 17. Mr. Miller had two previous charges in 1970 and 1973 and was fined $75, Wednesday. He also pleaded guilty to having liquor at a place other than his residence and was fined $38. Constable . Spitzig of the Goderich OPP, charged Kevin G. Kerr, 18, of 44 James Street, with driving with more than 80 milligrams of alcohol in his system. Mr. Kerry ran his car into a ditch at the time, but no one was injured. Be pleaded guilty and was fined $125 and his driver's license was automatically suspended. for three months. Kenneth' A. "MacDonald, of 6 8 James Street, did not appear in court on seven different charges ranging from careless driving . consuming liquor while a minor, and having liquor in a place other than his residence. The court issued a warrant for his arrest. Allan James McKay, of R.R.#2, Brussels, was charged with having liquor in a place other than his residence. He was found guilty and fined $53. Roy W. Taylor, .of R.R.#2, Seaforth pleaded guilty to the same charge and was fined $53. Patrick H. Murray, 26, of Main Street South. .was charged with careless driving, on June 11 when he ran into a parked car on Main Street with his four-wheel drive truck. Damage to the ether vehicle was estimated at $3,000 and the court was told that he told the officer he was making his way from one hotel to another. Mr. Murray said it had been raining, and Judge Hays said that was a good reason for going slow and the downtown area is very vulnerable because of the number of people crossing the street. Mr. Murray pleaded guilty and was fined $150. A best man may have been a little late for a wedding reception on Saturday , June 21. In his proclaimed haste to reach the reception at the Legion, he squealed his tires at the corner of John and Main Streets. He was further delayed by Constable Ron -Lauzon who charged him with unnecessary noise. Finn E. Madsen of Kitchener didn't appear in court but the evidence was read against him. The incident occurred at about 11:35 p.m. and his car left 15 feet of tire marks on the road. Provincial Judge Glenn Hays found him guilty and fined him $78. James J. Rivers of 167 N. Main Street was found guilty and also fined $78 on a charge of creatir unnecessary noise. Constable said the incident occurred May 3, about 1:20 a.m. on Huron Street when he was on patrol. He later measured the tire marks as 35 feet long; .Judge Hays said at any given time a car may create unnecessary noise but the size of the fine requires police generally to b,e rather selective in charging people.The Judge can always rethice the fine. Hie advised the police to charge people when noise becomes a nuisance.
