tracks around where my vehicle
had been., When I 'contacted the
police to report a stolen car, they
informed me that they had re-

the authority to move my par?
ANSWER:
They got their authority from
the same section of the Highway
Traffic Act that likely you would
be charged under, Section '89.
Section 89, Subsection (11) states
'A constable or an officer ap-
pointed for the carrying out of
the provisions of this Act, upon
discovery of any vehicle parked
or standing in contravention of
Subsection 9, or of a municipal

QUESTION:
Dear Constable:
Can I be charged for operating
ANSWER: , c a snowmobile on the sidewalk?
No, they are not allowed to-go ANSWER:
wherever they wish, especially I would say yes, but the final
private property. Your land is 1' answer would come from the
your land and you have t4e right
to say who comes on it. It is
true you could put up signs sta-
ting 'No Trespassing', but what
would our cities and towns look
like if everyone had to put up
signs during the winter for a
few- inconsiderate snowmobile
operators. Persons who operate
snolvmobiles, etc., on your pro-
perty are, trespassing and 'Could
be charged if-they are instructed
not to go on the property and
refuse to' leave after you have
told them to do so. There are
many snowmobile clubs who are
just as 'concerned as you. If the
s&tnation gets out' of hand; by-
laws ,can bade to prohibit
the tar of snowmobiles.
courts. There is no specific
charge such as Driving on Side-
walk under the regulations per-
taining to snowmobiles, but I
feel that the section dealing with
the careless operation of a snow-
mobile would cover the matter.
To quote, 'Every person is guil-
ty of the offence of driving care-
lessly who drives a motorized
snow vehicle without due care
and attention or without reason-
ableiconsideration for other per-
sons'.
QUESTION:
Dear Constable:
When we are operating our
snowmobiles in groups on the
highway in single file, how much
space should we allow between
snowmobiles?
ANSWER:
There is no specific number
of feet mentioned in the regu-
lations,, they just state that the
driver of a motorized snow ve-
hicle shall not follow another
vehicle or motorized snow ve-
hicle more closely than is rea-
sonable and prudent, having due
regard for the speed 9f such

cadent?
AsswEri:
No if it is used on, .private
property, but OA regulations
state; 'No person Shall drive .a
motorized snow vehicle upon a
highway unless he is insured
under a motor vehicle lialdlity
pOlicy in accordance with the
Insurance Act, and the owner
of a motorized snow vehicle Shall
not permit any person to drive
the vehicle upon a highway un-
less the triver is so insured.
QUESTION:
Dear Constable:
Can municipalities pass rules
• or regulations prohibiting the
use of snowmobiles?
ANSWER: •
Yes, they can. The regula-
tions state the following: 'The
council of a municipality may
pass by-laws prohibiting the dri-
ving of motorized snow vehicles
along or across any highway or
part of a highway under its Juris-
diction and that Part XXI of the
Municipal' Act applies to by-laws
passed under Siibsection 1.'
