ANSWER: The car is not required by law to wait until the behicle has been safely parked, but it would. be the safe thing to do. If he does decide to pass, there are several things which the driver who pulls out to pass must do. The Highway Traffic Act states; • "The driver or operator of a vehicle upon a highway before turning fc)om one lane for traf- fic to another lane for traffic shall first see that such move - ment can be made in safety, and if the operation •of any other ve- hicle may be affected by such movement shall give a signal plainly visible to the driver or operator of such other v ehicle of the intention to make such move- ment, and in another section it states, Any person so overtaking another vehicle or horseman shall turn out to the left so far as may be necessary to avoid a collision with the vehicle or horseman overtaken; and the person overtaken is not required' to leave more than one-half of ' the roadway free; he must also make sure in •front of and to the left of the vehicle to be passed is safely free from approaeliin—g— traffic and also that the left of his vehicle is safely free from overtaking traffic.
