Towriship, we are of the opinion
that these pupils have a rillt,to
attend our schools. Our conten-
tion is based on the facts that -
1. children of residents living
on the lots referred to above had
the right to attend the 'school in
' the North Ashfield Union School
Section.
2. Subsequently, but before`Jan-
uary 1st, 1969 , the former Noith
Ashfield Union School Section
was absorbed into the Ashfield -
West Wawanosh Townships School
area. Pupils referred to, under
this arrangement; still had the
right to attend school 'in the
school area.
3. With the formation of county
boards of education on_January 1,
1969, pupils referred to above,
due to previous rights of attend -
ance, were guaranteed continuan•
ce of their rights under section 43
of The Secondary Schools and
Boards of,Education Act. R.S.O.
1970, cc. 111, 385, 424.
In summary may I state, most
emphatically, that we are oppos-
ed to this unilateral decision of
your Board to withdraw pupils
from a school we are convinced
they have a right to attend under
the laws of the Province.
The issue in question seems to
boil down to 'an inteipretation
of the schools and •b&rds-of educa •
tion act , each county school
board believing they have the
right interpretation.
The portion of the act that con-
cerns the problem which has aris-
en reads as follows:
(1)' Where,, on the 31st day of
December, 1968, a pupil is enrol-
led in a public or secondary
school that he has •a right to
attend and the school on and after
the 1st of January, 1969, is situat-
ed in a school division other than
the school division in which the
pupil resides, the pupil has, in
addition to any other right that he
may have under The Department
of Education Act, The Public
Schools. Act, The Schools Admin-
istration Act or this Act, subject
to subsection 5 of section 63, the
right 'to attend the school until
he completei his education in the
school. •
(2) Where any part of'a school
section or secondary school
district, after the 1st day of Jan-
uary; 1969, forms part of a school
division other than the school
division in which the school that
the pupils resident in such part
had a right to attend on the 3l
day of December, 1968, is sit-
uate, all pupils who reside in
such part after the 1st day of
January, 1969, may attend such
school until.the divisional •boards
concerned agree to other
arrangements for the accommo-
dation of such pupils.

Bruce Stand
The Bruce County Board of
' Edudation has taken the position,.
that paragraph 1 does not apply .
in this particular case. All.
students enrolled in a particular
school on December 31, 1968
have completed the education
offered 'in that particular school.
It is paragraph 2 that seems to
produce two separate interpreta-
tions by the. Bruce and Huron
Boards.
Bruce maintain that this partic-
ular paragraph gives students the '
right to continue to attend North
Ashfield School (the school that
the pupils had the right to attend
on•December 31, 1968) and that'
they may attend such school un-
til such time as the boards con-
cerned reach any other agree-
ment'.
But they do not feel that Tara-.
graph 2 applies to students who
attend 'Brookside. Their thinking,
is that children starting to SchOol
at that time would attend North'
Ashfield,. not Brookside, and that
the right for a choibe does not
extend past North Ashfield:
Huron. Opinion
In the Huron letter to the
Bruce board, it was pointed out
that before January,l, 1969/, the
forrner North Ashfield Union
School Section was absorbed into
the Ashfield-West Wawanosh
Township School Area. They
state that the pupils referred. to
still have a right to attend school
in the school area.
They maintain that at the
time 'of the formation of county,
school boards, the North Ashfield
Union School section was no
longer such and was a portion of
the newly formed ,two township
school area.. As such, pupils
would have a right to attend
school anywhere in the area , ,
Which right still, exists.
Advantages.
The Sentinel contacted the
Bruce County Board' of Education
and asked Of the director'of edu
Cation what advantages or bend ,'
fits could be gained by .the
pupils in such a change.
Three factors were offered: •
1. proximity school, the Ripley
Huron School being 'closer than
Brookside;
2. Orientatipri.to prograrris.in t8c -
ondary schools. Under the new
boundary agreements last,year be-
tween the Bruce and Huron boards,
the students in question will attend
secondary school'in Bruce County.
It is felt by the Bruce board that
the secondary school orientation
program in Brookside is geared to
Goderich and Wingham High
Schools, where the students, in
question would not be attending,
and that they would be better pre-
pared for secondary school if they
were receiving seconddry school .
orientation to Bruce County high
schOols where they will be attend-
ing.
3. There would be a -disassocia-
tion of friends made throngh pub-.
lic school as the few students in
question• would leave Brookside
to attend schools in Bruce 'while
most of their fellow students
would attend either Goderich 'or
Wingham Secondary schools.,
There 'would' also be f ncial
advantages for the Bruce Board
who could absorb these students
at no additional Cost in their '
Ripley School as opposed, to
paying tuition to the Huron
County Board while attending
Brookside.

Mr. Andrew •Barkwell has sold
his farm to Mr. and Mrs. 'Irwin
Campbell, and held a very suc-
cessful auction sale on Saturday.
Mr,' and Mrs. Eldon Bradley
have sold their dairy herd of
cattle. The Bradleys have been
in the dairy business for a good
number of years and have long
been known for their, fine cattle.
Sympathy of the community is
extended to Miss Margaret Mac ,
Leod and other relatives in the
passing of Kenneth MacLeod in
Goderich Hospital on Wednesday.'
Gary MacKenzie, who has
• been in the Western Provinces for
some time, has returned home to
the area, and plans'to farm here.
Miss Donna Wylds of London •
spent the week end. with her par-
ents Mr. and Mrs. Warren Wylds,
Donna will graduate in May as a
nurse. '
