Found Not Guilty On Non-Capital
Murder Charge On Grounds Of Insanity,
Additional Charges To Be Heard Later

ated,for nearly three hours Wed-
nesday,of last week before find-
ing Dale McKee, 22, of Tees-
'water, not guilty of non-capital
murder on grounds of insanity.'
• Dale will be returned indefin-
itely to the Ontario Hospital at
Penetanpishene, where he'has
undergone nine months of inten7
sive therapy since 'his arrest.

Donaldson, a Tekswater imple-
ment dealer, had been shot to
death in the driveWay of his home
The slain man's son, Steven,
20, and a 21 year;-old, friend,.
Douglas yall, were wounded in
the flurry of .22 calibre rifle fire.
. The rifle was found ,'fully load
ed, in the front seat of McKee's
car, when he was arrested.
Defence attorney James Don-
nelly of Goderich didn't dispute
that McKee fired the shots, but
called three psychiatriSts who
testified the accused was a` Para
void schizophrenic and. legally
Insane' at the time.
Defence evidence showed four
doctors certified and re-certified ,
McKee as being mentally ill '
during his stay at Penetanguisriene.
During the trial, Steven Donald:
son and Douglas Wall testified the'J
had broken off their ,friendship
'with McKee after he began to
"change" during the summer of
1971.
They told the court McKee
Withdrew from younger
people and became moody, shifting
rapidly from elation to' depression.
McKee followed them continu-
ally and harrassed them, occasion-
ally with violence, they said.
Crown Attorney George Pater-
son argued in his summation to the
jury Wednesday. McKee was sane
at the time of the shooting.
He said the incident resulted
from a long-standing "grudge"
the youth held against SteVen
Donaldson and Mr. Wall.
Mr. Paterson said McKee's
agitated behaviour while he was
being examined by a, psychiatrist
less than 24 hours after the incid-
ent was "normal under the circum-
stances."
In his.hour-long instruction to
the jury, consisting of 11 men and
one woman, Mr. ,jUstice T. ,G.
Zuber said the psychiatrists' evid-
ence was difficult toagnore, be- •
cause the Crown had' called no
Witnesses to reftite'the testimony.
"Obviously psychiatrists can't
.open a man's mind ;but they are
the best we l-zave," he said.
He said the'killing of Mr.. Don-
aldson iKas apparently without
motive and not "grounded in
reality" since McKee's quarel
was with the younger Donaldson
and Mr. Wall.
"It was a senseless• killing,"
he said.
Crown. Attorney George Eater=

attempted murder which .McKee
stir..faces in connection with
