Municipal Council of therown
of Clinton to enter into an ,ag-
greenlent with. the Clinton
Electric Light Co tor,the sup-
ply of ele(tric light within the
said Corporation, and the use
of the streets in connection
therewith. .
WHEREAS the Clinton Elect'. lc
Light Co, has heretofore supplied elec-
tric light. within the Town of Clinton.
and is desirous of securing the right to
supply light for street lighting and for
public andprivate use within the said
Town for a further period.

electric light for public and private use
tor the considerations and subject to
all the terms and conditions wbich are
contained in the agreement; which is
set forth as Schedule "A" to this By.

Oouncil of the saidTown deem it in the
interests of the Corporation .to enter
into such an agreement.
BE IT, THEREFORE ENACTED
BY THE MUNICIPAL COUNCIL
OF IHE CORPORATION OF THE
TOWN OEs' ULINTON AND IT IS
BEUEBX ENACTED AS FOLLOWS:
I. It shall be lawful for the Oorper-
ation of the Town of Clinton to enter
into thesaid agreement incorporated
herewith and forming part of this By -
Law and marked Schedule "A" to this
ByLaw and to perform and fulfill all
covenants and obligations on the part
of the Corporation therein contained
and the Mayor and the Clerk ot the
saidOorporation are hereby authorized
for and on behalf of the said Corpora-
tion to execute and .leliver the Said In-
denture of Agreement set north• and
contained in the said Schedule "A" to
this By -Law
2 ThisBy-Law shall come into force
and take effect on the final passing -
thereof. •

Law on the 2nd day ot May, 1910, const
mencing at the hour of 9 o'clock in the
forenoon and continuing until 5 o`clock
in the afternoon of the same day at the

9. No lamp erected by theOompanv
under tne direction of the Town shall
be removed without leave of the Muni-
cipal Council of the Town.
10. The Municipal Council may re-
quire the location of any lamp • to be
changed at any time and the Company
shall upon reasonable notice remove
the same to such. new location as the
Council shall fix upon and tne cost of
such removal shall be borne by the
,awn,
' 11. The Town shall pay to the Com-
pany for the street lighting the annual
sum of thirteen hundred and forty-two
dollars (31312,00) for one hundred and
ten. lamps, the same being at the rate
of $12 20 per lamp per year.
12. TheQompany shall upon reason-
able notice, erect, furnish, repair and
supply current to other street lamps
of the character hereinbefore describ-
ed to each number as.the Town shall
require, at any time or times during
the currency, of this contract,and such
additional lamps shall in all respects
conform -to the same conditions as the:
110 lamps hereinbefore provided for,
except only that such additional' lamps
as shall be providedover and above the
aforesaid 110 shall be paid for by the
Town at the rate of ten dollars per
lamp per annum'; the Company shall
not be entitled to receive any other re-
muneration for the erection or com-
pletion of the additional lamps and
the necessories .thereto.
13. All sums payable by the Town
for service under Ibis agreement shall
be payable in equal monthly instal-
ments

during the .currency of this agreement

on the first day of November next
(1910).
14. The contract shall came into
operation on the first day of October
next (1910) and subject to the further
conditions hereof shall continue for
the term of ten years.
15. In event of a By -Law of the said
Town being passed and coming into.
force for the manufacturing and sup-
plying of electric .light by the Corpor-
ation under the provisions of TheMun-
icipal Light and Heat Act or of any
other Act ot the Legislature of the
Province of Ontario, then in such
event this aggreement shall lapse and
be wholly void•and at an end upon the
termination of the :• period of three
months „after the publication. of the
award of arbitrators appointed under
the provisions of the Municipal Act to
determine the value of the • Company's
plant or after the acceptance by the
Company of an offer made by . the
Town under the Municipal Act as the
case may be (provided the Town shall
not have given notice of. non-accep-
tance of the award or of withdrawal of
their offer) ; and in such event it is
further expressly provided and agreed
that iu estimating the value of the said
Com_pany's• assets to be purchased by
the Town in pursuance of such by-law
and the btatutes.pertaining thereto,no
allowance shall be made to .the Com-
pany for prospective .profits or frau-

16. Uponspecial order of the Mayor
of the said ;Town, the .Company shall
on any. particular night, supply street
lights till such late hour as the Mayors
order. shall. require and such extra ser-
vice shall: be paid for pro -rata to the
service hereby contracted for.
17. If the Company at any time, in
the opinion of the •Oouncil of the said
Town, shall fail to furnish proper light
on either the street or the private sys-
tem, the system may be tested by the
inspector appointed under The Electric
Light Inspection Act and if the light
shall be found to be below the proper
standard and tne defect shall not be.

5. Meters' shall be supplied by the
Company to all users of electric light
requiring the same and.the rent pay-
able therefore shall not exceed 25 cents
per month. •
6, The Company shall erect and
completely furnish upon the streets of
the said Town. a system at least one
hundred and ten lamps of the kind
known as 50 watt tungsten lamps and
shall provide the same with all neces-
sary accessories and keep the same in
proper repair and shall supply electric
current sufficient to maintain a light
of at least forty candle power for each
limn which light: shall be maintained
at all lamps from dusk till midnight for
three hundred nights per year and
shall also maintain at locations near
the centre of the Town three of such
lamps which shall provide light from.
dusk till dawn every night. •
7. The three hundred days per year
referred to in the next preceding para-
graph, shall be apportioned so that the
light shall be supplied on twenty-five
nights per moptl�d nights wben no
