O'Con- nor, Esq., of Walkerton, conducting the cases for the Crown. The follow- ing is the pannel of the Grand Jury worn in : - GRAND JURORS.—George E. Cress- avell, Tuckersmith, foreman ; Wm. His Lordship then addressed the panel on the calender, which, he said, though a long one, contained but two very serious cases. One of these, for- gery, he stated, was formerly punished with death. The only peculiarity of such cases was, thongh the person ,whose name bad keen forged was a com- ipetent witness, he must be supported ,hy .corroborative evidence. Here the Justice read the law bearing on this point. The other offence particularly noticed was a charge of shooting with intent to kill. Though the offence was not completed, the Grand Jury ,were to consider this as a question of .fact. whether the shooting had been ,done .with intent to kill or do bodily' ahem). Most of the others were sim- ple larceny, with one of false preten- ces. The latter crime was now made a ,misdemeanor, and the justice explain- ed that the false representation could not be made with regard to anything past or future, but must haye been such .a presentation of some existing fact as .induces a .person to part with his :property. In exanining•such witnesses .as were sent before thelia, it was ,not .necessary to examine before than two ,or three, in order to determine the.char- acter of a bill, and these witnesses must be all on behalf of the crown. The Grand Jury were then ;taken' in charge by Constuble Youill, and the court proceeded with the calendar. The following cases have been tried : Denholm vs. Colles. An action on ,note and' account. This was a jury case, but his Lord - .ship dispensed with jury, and deft. ibc>hig.called 'and not appearing, a ver- dict was ,rendered for plff. for $468, :with costs. Glasgow vs. Ryan. On coating into Clutton to receive payment, he demanded $5 n;ore, which Kerr refused to pay, hut offered a pair of boats in addition to the price ,first agreed en. Rouse .refused to ;accept it, and on the evening .of August 2ieh fawn.] took the horse away freKerr'pram,:- iser; when the latter had been .arrested for stealing: IIe was tried before Judge Toms and acquitted and now brought suit for malicious prosecution. Wilson, for forgery, Ant; - •uas, Johnston, for larceny, THIRD DAY. Queen vs. Thomas Carter. Prisoner was arrainged for shooting with intent, and pleaded not guilty ; but with the consent of the Crown he withdrew his plea and pleaded guilty of common as- sault. Sentence deferre6. On the charge of having a pistol on his person with intent he pleaded guilty. Queen vs. John E; Barnes. Prison- er was arraigned on wo . charges of forgery, to both of which ne pleaded not guilty. M. S. Malcomson—defend- ed, and the jury returned a verdict in each case of not guilty. Queen vs. Chas. Johnston. C arged with the Iarcency of a beehive. `ar- row &Proudfoot for _prisoner. T jury returned a verdict of not guilty.. Wright vs. Schofield. Action of ejectment. Malcomson & Wade for plfl•.:; Garrow & IB,roudfoot for deft. His Lordship returned :a %verdict for -- plaintiff Wright for all the premises .except, the house, aun for the defend ant, William Schofield, for the dwell- ing house ; costs of the suit to plain- tiff against him, and as the wife was nota necessary party she was awarded costs and the action dismissed as to her. Queen vs. Chas. Wesley Graham. Two charges of embezzlement, on each of which the. 'Grand Jury returned. "No bill." True bilis were presented in the Queen vs. !Cary Ann Flynn, assault, and William Bone and James Bone, fon larcency. Mclntush .vs. .McGunigle. Action ,for ejectment. Garrow & Benson for .plff.; F. Holmstead for deft. Court adjourned during this case, and on the FOURTH DAY continued it, when his Lordship ren - del ed a verdict for plff. with costs. Queen vs. Thos. Low Wilson.
