The plaintiff, Paul Yesbec, is a pedlar in Goderich, and the defendant is the duly appointed executor and trustee of the estate and effects of plaintiff's brother, Peter Yesbec,Iate of the town of Olinton, who, the plaintiff claimed, made a promissory note on October 15, 1002, in favor of the plaintiff for $035, payable on demand, with interest at the rate of 5 per cent, per 'annum, on which it was claimed there was now owing $1,307,05. The plaintiff also alleged•a loan of $100 by him to the estate of his brother for funeral services in Syria. His Lordship directed judg- ment to be entered for the plaintiff for the sum of $402,05, with costs on the County Courrecale; thirty days' stay.
