Credit card theft, use results in probation, restitution
In Wingham court in June, Louis
Flood of Wingham pled guilty to
eight charges of unlawfully using a
credit card and one count of assault
and he was sentenced on Aug. 18.
Laura Grant said that on June 15,
2015, police were called to Flood's
Wingham apartment with reports of
a domestic disturbance. Upon
arriving, police were met by a
"visibly upset" woman who said
Flood, her ex-boyfriend, had pushed
her and grabbed her around the neck.
Police reported marks consistent
with the woman's claims, saying she
had red marks on her chest and neck.
She also told police that she was
several months pregnant.
The woman initially declined
medical assistance, but when
officers were told the woman was
pregnant, they sent her to the
hospital for examination, where she
was told her child was fine.
When police questioned the
woman, she said that Flood's
behaviour was uncharacteristic and
she felt he may have been using
drugs. Police also observed a
number of marks on Flood, which
was consistent with his claim that
the argument between the two got
physical on both sides.
Flood agreed with the facts as
stated by Grant and was found guilty
by Brophy.
Flood was further charged on eight
counts of using a credit card between
Feb. 2-7, 2016 that he knew was
obtained through the commissioning
of a crime.
Grant said that in early February, a
woman attended her mother's
Wingham home to check on it while
her mother was vacationing in

Florida. The woman noted that the
back patio door was closed with a
curtain caught in it, which signalled
to her that someone may have
unlawfully entered the home.
Upon further inspection, the
woman found that a number of
drawers and rooms had been
rummaged through and that her
mother's MasterCard was missing.
On March 9, the woman reported
to the Wingham police station with
her mother's credit card bill,
which included over $4,000 in
charges the woman said she didn't
authorize.
The purchases, Grant said, were
made throughout Wingham and
through various online retailers.
Flood was eventually identified,
Grant said, through various means,
including video footage from
Wingham's Rexall pharmacy, an
online purchase which Flood had
shipped to himself and a warranty
card for a cell phone Flood
purchased. He filled out the warranty
card with his own contact
information.
Flood also pled guilty to those
charges and agreed with the facts as
presented by Grant and as a result
Brophy found Flood guilty of all
charges.
Brophy said he had experience
with Flood and remembered him
from court a number of years ago.
He also recalled commissioning a
pre -sentence report at the time.
Since those arrests were over five
years old, as was the report, Brophy
said he felt it was likely time for an
updated pre -sentence report, which
was presented on Aug. 18.
Brophy called the report
"positive" and handed Flood a
suspended sentence and a two-year
term of probation. He gave him a
$10 fine (with a $3 victim fine
surcharge) and he has to pay
$1,363.02 in restitution associated
with the credit card use.

attended the apartment, MacTavish
answered and told police he was
living in the apartment.
While police couldn't prove that it
was MacTavish smashing things in
the apartment, they knew he was not
to be on any Huron County Housing
Corporation property, a condition to
which MacTavish had agreed.
MacTavish agreed with all three
sets of statements and pled guilty.
His lawyer, Scott Cowan, asked that
a pre -sentence report be ordered
before sentencing for the mischief
charge and the April 3 failure to
comply charge before sentencing,
but said he'd be comfortable with his
client being sentenced on the Jan. 7
failure to comply charge.
Judge G.J. Brophy ordered the
pre -sentence report and sentenced
MacTavish to a 12 -month term of
probation on the Jan. 7 charge. With
MacTavish not having a fixed
address, he ordered him to report to
Wingham Police regularly.
In Wingham court on Aug. 18,
MacTavish was sentenced to five
months in jail for the charge of
mischief. He received an additional
30 days as a result of his breach of
the conditions of his probation.
He also issued a fine of $10, which
carries with it a $3 victim fine
surcharge. MacTavish's jail time
also carries with it a victim fine
surcharge of $200.
Brophy also placed MacTavish on
probation for two years upon his
release.
Brophy noted that in MacTavish's
pre -sentence report, it stated that he
had a "profound" drug problem and
his criminal record, including 17
prior offences, seven of which were
when he was a young offender.
When it came to restitution,
Brophy noted that MacTavish is on
the Ontario Disability Support
Program (ODSP) and wouldn't
likely be able to pay. He said it
would be "foolhardy" to expect
MacTavish to pay restitution and
that society would simply have to
"absorb the loss".
