NOW THEREFORE THE - MUNICIPAL COUNCIL OF THE':
: CORPORATION OF THE' . VILLAGE OF. L,UCKNOW, ENACTS '
AS FOLLOWS:- .
1, "Fireworks” 'shall. ' mean 'and• include: any combustible or
explosive composition or any substance or combination of sub-
stances or. articles prepared. for ' the purpose' of producing . a
visible or" an audible effect ' and shall include toy guns in
which explosives are used, firecrackers, 'torpedoes,skyrock-
ets, ;Roman' Candles, sparklers and- pyrotechnics : of all kinds,
except; that the . term fireworks shall not include auto flares,
paper caps • containing not in excess of twenty-five hundreth
of a grain of explosive content per cap and toy pistols for
use of. such caps.
• 2. (AY' Except as hereinafter provided it shall be unlawful
• for any person • to. offer ,for:' sale, expose for •sale,sell at re-
,tail, or use or explode' any fireworks, provided that the ' Chief'
of the Fire Department shall have power to adopt reasonable
'rules ;and . regulations for the 'granting of permits for' super-
vised public' displays .of' fireworks 'by municipality, fair as- ;:
•,sociations,.,:amusement parks, and other: organizations.. Every
such display shall be' handled :by a competent operator:: approv-
ed by the Chiefs of the' Police.•and/ Fire 'Departments of . the
Municipality, and shall : be of such character and so located,
.' discharged or , fired as. in the opinion of the Chief of. the''
Fire Department, after proper .: inspection, shall • not be ,haz-
ardotis to . property' or endanger any. person:
'('B) Application• for permits :shall' be 'made in writing to the
Municipal Clerk •at. least fifteen days in :Advance' of the •,date,
of , the,display. After such privilege. shall :have, been granted;
sale; possession, use .and ,distribution 'of ,fireworks.. for such
.display .' shall be . lawful . for that purpose only: NO permit
granted hereunder shall be transferable:
3. Nothing in this article ` shall be construed 'to :prohibit any
resident wholesaler, dealer,or jobber to sell - at . wholesale
such fireworks as are not 'herein prohibited; or the sale 'of
any kind of `fireworks provided the sale are to be shipped di-'
rectly . out of the municipality; of the use of• fireworks.. by
railroads or er transportation agencies ,for. signal purposes
or illuminatio or, the sale• or use of blank cartridges for a
:.'theatre,Y y
show or: for signal 'of ceremonialpurposes in ath-�
leties" or s orts or for u e by military organizations.,
•4 Every Person.' who contravenes any of the provisions of
the by-law is guilty :.of an offence and is liable upon convic
tion thereof to a fine of not .more than $50.00 exclusive of
costs and such penalty shall be recoverable under ..the Sum-
• mary 'Convictions Act.
5. Irl . case' the provisions of this By. -Law conflict with the
provisions of any other By -Law, the „provisions 'of this By-
Law shall prevail
6. ' This . ,By -Law shall ,come into force and take effect ' upon
the passing thereof. ' •
