Raynard Akkert stated that he
followed the car`, which was driv,
en • in a; very erratic Manner;' for
,approxirately seven miles. ' By
erratic he :meant that' the speed
varied • greatly •. and the • car .did
not always proceed in• a straight
course. Although -not 'being able
to overtake 'the. car,' he w.as •suf

Ackert' yelled to two other driv-
ers at the, corner,' and, they also
took•' up the chase, The• car of
one of • the ..latter,. travelling at
high speed, was .able to overtake
the defendant,. and crowd himoff
to the side of the road. The other
two vehicles then 'hem ned him in

Ackert' said 'he got out of. his
'car` and -went to the man behind -
the wheel, -beside' whom on the
front seat was .the•.little girl. He
asked '•h°im, "Where did you get
that- girl?" •
The man replied; "I am taking
her.. home". Ackert said -he then
saw Harold Bannerman,. driver
of the car who had . overtaken

take Desmond, and which he was

his nephew, Douglas Bannerman;
who later • took the. girl , to the
home of his parents. He said,

In passing, sentence Magistrate
McC1evis told 'Desmond that by
his` own evidence he had .been
in a stupor and didn't• know •what

of spell before: Yet knowing, this
•fact,, the conditionhe gets in
mentally atld- physically, he pro-
' seeded: to get drunk , and •then
into his 'car. "That is .What you
brought airs yourself", he said. In

is no defence; and,he did not see
why. it should be 'here. •
