The case against Huron East mayor,
Bernie MacLellan, has been dismissed,
almost a year after he was charged of
assault following a dispute over a
trailer.
The mayor had been charged with
two counts of assault with a weapon
after an alleged incident involving a
mallet took place at the Lakeside Flea
and Farmers Market in Ashfield-Col-
borne-Wawanosh Twp. on Dec. 12,
2012.
The charges were dismissed in
Goderich court Dec. 9.
According to MacLellan, Ontario
Court Justice R.G.E. Hunter dismissed
the charges after the Crown told court
there was not enough evidence to
continue.
"I got a call notifying me the Crown
had reviewed the information and
were asking for the whole thing to be
dismissed," he said, adding even
though he was told he was not required
to appear for the dismissal, he thought
it was appropriate to attend. "It was
very anti -climactic, it took about 30
seconds and it was over."
Testimony from the couple involved
was presented to the court in July, but
when it was discovered the trial was
going to last longer than just the one
day, it was adjourned until Dec. 11.
The decision to dismiss the charges
means the court will not hear from the
remainder of the Crown's witnesses or
those of the defence.
MacLellan explained he was both
happy and frustrated now that the case
is over.
"I'm happy about the fact that the
ordeal is behind me, from that stand-
point, but I'm really frustrated about
the entire process," he said, adding his
legal council told him this kind of case
wouldn't normally make it to court,
but it was a different case due to his
status as a public figure. "They didn't
want to show any favoritism at all and
that's why I got dragged through the
ringer."
