Keith vs.. Brown and Liticlater vs.
iorr"iron ..... _ .. -
Two court cases of more than •or-
dinary interest were settled at Walk-
erton :last week,- by agreement be-
tween the litigants,$ while evidence a
was being taken.
The 'first case to come up was that
of. Dungan ,Keith, a Culross farmer,
against J. .11`..:Brown, automobile
dealer of Teeswater..It appears that
Keith, after selling his farm in Cul -
row formed a'. partnership with.
Brown, their, plan being to open a
. - garage and sales agency at Kinear-
dine'where Keith was to have cherge.
After being in the businiess • for .a •
short time, Keith wished- to - withdraw
and the Kincardine proposition was
sold. Keith "vias to get 4,f00 out of
the business but ,Bt'own instead of
paying. cash 'gave. Keith the •amount
in• Teeswater 'Foundry bonds. Brown
maintained' that this was a settle-
ment while Keith claimed that he
took the bonds only_as • security and.
wanted cash. After the case had Pro--,
seeded throughout Tuesday and until
nesday-it-,.noon, the--parties..,.go.L
together and effected a settlement by
which ?°drown paid cash for$2,500 of
the bonds. • ' udge a . rey siroi"gly
advised ihe . parties to get together
and try to effect a settlement, which.
they finally succeeded in. doing.
The other case was that' of $'arrtey
Linklateal formerly of. Teeswater,
who two years ago bought the under-
taking and futnitttre . business of W.
J. Morrison, Kincardine; for, it is
said $24,000. He claimed that the
Jiusi less Ead" been' misYepresetitetl to
him and that he had been induced
to pay too much for it. He wanted':
$4,000 thrown .off. The judge also
advised these to try to make a 'set-
tlenient as 'being th better way for
all. The disputants.. finally succeeded
in doing this, Morrisen agreeing to
aeeept ,$20,000 for . the' beisit►ess..'
