Appeal of wind
turbine Charter
challenge denied
Postmedia Network
The Ontario Court of Appeal has
declined to hear the appeal of four
southwestern families battling
against wind turbine projects.
The families had lost a Charter
challenge last year and were seek-
ing an appeal of the decision.
They contend that provisions in
the Environmental Protection Act
approving renewable energy pro-
jects "exposes them to a reasonable
prospect of serious harm to their
health and therefore does not com-
ply with the Canadian Charter of
Rights and Freedoms."
The Ontario Divisional Court
ruled against the four families (the
Drennans, Ryans, Dixsons and
Kroeplins) on December 29, 2014.
Shawn Drennan, one of the
appellants in the case, said in a
media release, "We are disap-
pointed with the court's decision
not to hear our case. No one has
been able to tell us that the tur-
bines are safe. We are being told
we have to wait to be harmed
before we can do anything to stop
them."
"The court has given us two
choices: leave the land my family
has farmed for three generations or
be a guinea pig for the government
and the wind companies," Drennan
added.
Julian Falconer, the lawyer for the
families, said the decision leaves
his clients and others in an "impos-
sible position."
"The Health Canada Study has
already shown an association
between the turbines and serious
health effects," Falconer stated in
the media release.
The Health Canada study,
released in November 2014, indi-
cated there is no evidence of a
direct link between wind turbine
noise and health effects.
However, it did note there can be
a connection between the noise
and annoyance, and that those who
are annoyed are more likely to
report other health issues.
The four families were originally
ordered to pay $340,000 in court
costs to three companies, K2 Wind
Ontario, St. Columban Energy LP
and Armow Wind, but that figure
was later lowered to $67,000.

The 4-H Burlap Bunch went on a
field trip to Janice Bizback's
antique barn. They got to see all
the different antique rugs in the
barn. Some were very old! It was
interesting that some designs were
drawn and some were free styled.
They also got to go on a tour of the
whole antique barn. After that
they looked around to see what
neat things they could find. Janice
was really nice to let us come and
see her antique barn, it was really
cool.
The 4-H Burlap Bunch is very
excited to be a part of the Hensall
fair. We will be putting our rugs
into a special class, and they will
be judged on how well we made
them. We will also be participat-
ing in the parade so please watch
for us! If you are a past, present or
future 4-H member you will get a
sticker at the fair. We will have a
rug hooking demo from 3-4pm on
saturday June 15th. It will be at
the community hall in Hensall.
